1. SCOPE AND SUBJECT OF THE CONTRACT
This is the website of LACALUT, a brand from the company Dr. Theiss Naturwaren GmbH, Michelinstraße 10, 66424 Homburg/ Saar (hereinafter referred to as “Dr. Theiss Naturwaren” or “we”). Your access to this website and use of the data available here are subject to the following conditions and laws relating to this. On viewing the website you accept these terms.
If you do not consent to the general terms of use set out below, please do not use this website. These usage terms apply exclusively: we do not recognise contrary or different terms unless we have explicitly agreed to their application in writing. We reserve the right to modify in full or in part the following usage terms and our website at any time without notice and/or to stop operations. We therefore request that on your next visit to this website you again view these usage terms and make yourself aware of changes.
The download area of the website is mainly aimed at business people, such as pharmacists or journalists who can download from there photos of products for their own use as stated in these usage terms. The access to the download area is only permitted under the requirement that these General Usage Terms are accepted.
2. PROTECTING THE CONTENT, THIRD-PARTY CONTENT
The content available on the website is mainly protected through copyright and other protective rights and is owned by Dr. Theiss Naturwaren or other third parties who have provided the content. The assembly of the content as such is protected as a database or group of databases as defined by Sections 4 Para. 2, 87a Para. 1 of the German Copyright Act - UrhG. You may only use this content in line with these provisions.
The content provided on the website comes partially from Dr. Theiss Naturwaren and partially from third parties. Content from other third parties is referred to below in summary as "third party content”. For third party content Dr. Theiss Naturwaren does not conduct any checks on the completeness, correctness and legality and therefore bears no responsibility or guarantee for the completeness, correctness, legality and up-to-date nature of the third party content. 3. USAGE RIGHT TO THE CONTENT AVAILABLE ON THE WEBSITE
If further use is not explicitly permitted in these usage terms or on the website through relevant functionality (e.g. download button),
- You may only call up and use the content available on the website exclusively for personal use. This usage right is limited to the duration of your contractual use of the website or subscriber area;

Neither Dr. Theiss Naturwaren nor third parties who are involved in the production, creation or transmission of this website are liable for damage or legal infringements that arise from the access to or impossibility of access, usage or impossibility to access, the use or impossibility of using this website or your reliance on the information on this website. This liability exclusion also covers claims for damages due to a potential virus infection on your computer as a result of using this website.
Dr. Theiss Naturwaren excludes liability for slightly negligent infringements of obligations as long as these do not relate to damages from injury to life, limb or health, guarantees or claims arising from the German Product Liability Act. The liability for the infringement of duties only the fulfilment of which permits the proper implementation of the contract and on the compliance of which you may regularly rely is unaffected. This also applies to duty infringements by the vicarious agents of Dr. Theiss Naturwaren.

This website may contain links to access other websites on the worldwide web. Before we include links to third party websites on our website, we always check the destination pages for illegal content. However we do not check the websites for which we provide links constantly for content changes. If however as part of a sample check or when notified by a third party we discover illegal content we will immediately remove the relevant link from our website.

The quality claims of Dr. Theiss Naturwaren include handling the user’s personal data (called “personal data” below) responsibly. The personal data arising from use of the website is therefore only collected, stored and processed by Dr. Theiss Naturwaren if required for contractual service provision and permitted by the legal requirements or required by legislators. Dr. Theiss Naturwaren will treat your personal data in confidence and in line with the applicable provisions in data protection law and not pass it on to third parties.
In addition, Dr. Theiss Naturwaren only uses your personal data if you have explicitly consented to this. You can revoke consent that you have issued at any time.

7. SAFEGUARD CLAUSE
If a provision of these participation and usage terms is or becomes invalid or ineffective this will not affect the validity of the remaining provisions.
8. APPLICABLE LAW
These usage terms are subject to the law of the Federal Republic of Germany.
9. JURISDICTION
If you are a business, legal entity in public law or special assets under public law, the exclusive court of jurisdiction for all disputes arising from these usage terms is the head office of the service provider in Homburg/Saar.
